Both OzLotteries and Jumbo Affiliates are involved in a deliberate breach of contract after first falsely claming the contract did not exist.
(Update: August 11, 2009 Jumbo Interactive Pty. Ltd (Jumbo Affiliates) now trades as "LotteryAffiliates.com")
Evidence of the existence of the contract is to be found in the enclosed email from OzLotteries referring to a "commission rate" payable under the existing contract

The existence of the contract is evidenced by performance in other ways...
e.g. payments made on behalf of OzLotteries into bank accounts.
A company which refuses to honour one contract attracts suspicion that it could also refuse to honour prize payouts.. also contracts.

They offer the same lotto games offered by Ozlotteries and may even cost less.

Tattersalls and NSW Lotteries may put their reputations at risk if they continue to supply product to OzLotteries and customers should buy direct from the supplier and not go through Ozlotteries at all, in my opinion.

The reasons for withdrawing recommendations to trade with these companies may be gleaned from the following copy of an email from Ozlotteries stating that it wants to "formalise" affiliate contracts but which actually issues an ultimatum that if affiliates do not agree to a variation in the terms of their contracts then Ozlotteries will breach those contracts by refusing to honour them.

The Company intends to retain all ongoing commissions due to affiliates under the terms of the original contracts which were 'lifetime' contracts.

i.e. The company is blatantly stating that it intends to retain for itself monies already potentially earned by affiliates under the terms of their long standing contracts with Ozlotteries. This amounts to Corporate theft, in my opinion.

The company falsely claims there is no "formal agreement" in spite of the fact Ozlotteries has been paying affiliates according to the terms of their contracts (agreements) in the past. (I am dumbfounded at how blatant these false assertions are.)

It follows that it would be unsafe to trust OzLotteries to pay out lottery prizes. Purchasing a lottery entry is in the form of a contract betwen the player and Ozlotteries. OzLotteries may refuse to honour any contract it enters with you.

Fake Australian lottery causes confusion overseas

People around the world are being sent emails telling them that they have won a fortune in a fake Australian lottery that claims to be endorsed by the Australian Government. Confused consumers have been contacting SCAMwatch and other government agencies to check whether the lottery is genuine.

Consumers are advised that the Australian Government does not operate a national lottery and the Australian Lotto Lottery (or similar) has not been endorsed or authorised by the Australian Government.

Lottery scams have been around for a long time. While many fake lotteries are easy to spot, scammers will go to extreme lengths to create official-looking documents, certificates or even websites to convince you that the prize is genuine. The scammers behind the fake Australian lottery are even misusing the ‘australia.gov.au’ domain name to create false email addresses to make it look like the lottery has official support.

Wherever you live, you could be the target of an international lottery scam. If you receive a letter or an email telling you that you have won money or a prize in a foreign lottery which you have not entered, you should check with the government in your country to see if the lottery is genuine before you decide whether to respond.
